Terms of Service

These Terms of Service ("Terms") govern your access to and use of "Label Maker - Print & Merge Labels" ("the App") and the related services, features, and content provided by the "FractalApps" team ("the Company") (collectively, the "Service"). By installing, accessing, or using the Service, you agree to be bound by these Terms.

1. Definitions

  • "Company" means FractalApps.
  • "App" means the Google Workspace™ add-on "Label Maker - Print & Merge Labels", including both the Google Sheets™ and Google Docs™ extensions.
  • "Service" means the App and all related features and support.
  • "User" means any individual or entity that installs or uses the Service.
  • "Content" means any text, data, labels, documents, or other materials submitted to, created by, or processed by the Service.

2. Eligibility

You must be able to form a binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. License and permitted use

Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal purposes in accordance with these Terms and any applicable policies.

4. User responsibilities

You are responsible for your use of the Service and for any Content you create or process using the Service. You agree that you will:

  • Use the Service only in compliance with applicable laws and regulations.
  • Ensure you have all rights, permissions, and consents to use and process any Content, including data from spreadsheets used for mail merge.
  • Not use the Service to create or distribute unlawful, infringing, or harmful Content.
  • Not attempt to reverse engineer, decompile, or interfere with the Service or its security features.
  • Not misuse the Service in a way that could damage, disable, overburden, or impair the Service.

5. Content and output

You retain your rights in your Content. The Service reads data from your spreadsheets and documents to generate label output as Google Docs™ documents. The Company does not claim ownership of your Content or generated labels.

6. Service changes, availability, and termination

The Company may modify, suspend, or discontinue the Service (in whole or in part) at any time, including to maintain security, comply with law, or improve features. The Company may suspend or terminate access to the Service if you violate these Terms or if continued use poses a security, legal, or operational risk.

7. Fees

The Service may be offered for free or for a fee, depending on the plan you select (if applicable). If paid plans are offered, fees and billing terms will be disclosed at purchase. Unless otherwise stated, payments are non-refundable except where required by law.

8. Third-party templates

The Service includes label templates that are compatible with products from third-party manufacturers, including Avery®, SheetLabels.com®, OnlineLabels.com®, Herma®, and others. The Service is not affiliated with, endorsed by, or sponsored by any of these manufacturers. All third-party trademarks are the property of their respective owners. Template compatibility is provided for convenience and does not guarantee identical results to the original manufacturer's software.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The Company does not warrant that the Service will be uninterrupted, error-free, or that generated labels will be perfectly aligned on every printer and label sheet configuration.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR, IF THE SERVICE IS FREE, USD $100).

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your Content, (b) your misuse of the Service, or (c) your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of the jurisdiction where the Company is established, without regard to conflict of laws principles. Where permitted, you agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for disputes arising out of or relating to these Terms or the Service.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Changes are effective when posted. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
