SMS Messaging Terms & Opt-In Consent

This page explains how recipients consent to receive SMS text messages sent through "SMS Reminder for Google Calendar" ("the App"), provided by the "Fractal Apps" team ("the Company"), and the terms that apply to those messages.

1. Program description

The App enables businesses ("Senders") to send SMS appointment reminders, confirmations, and related transactional notifications to their own clients and contacts ("Recipients") for scheduled appointments and bookings. Messages are limited to appointment reminders and related service communications. This is not a marketing program.

2. How consent (opt-in) is obtained

Recipients provide their mobile phone number directly to a Sender at the time they schedule an appointment — in person, by phone, or through the Sender's booking or intake form — and agree to receive SMS appointment reminders for that appointment. Consent is collected by the Sender before any message is sent. A Recipient's phone number is used only to deliver the reminders associated with their appointment.

The disclosure presented to Recipients at the point their phone number is collected reads substantially as follows:

By providing your phone number, you agree to receive SMS appointment reminders from [Business Name], sent via SMS Reminder for Google Calendar. Message frequency varies based on your scheduled appointments. Message and data rates may apply. Reply STOP to unsubscribe at any time, or reply HELP for help. Consent is not a condition of any purchase.

Message frequency varies and depends on the number of appointments a Recipient has scheduled. Recipients typically receive one or more reminder messages per appointment.

4. Message and data rates

Message and data rates may apply, depending on the Recipient's mobile carrier and plan. The Company and Senders are not responsible for any charges from the Recipient's carrier.

5. Opting out (STOP)

Recipients may opt out of SMS messages at any time by replying STOP to any message. After replying STOP, the Recipient will receive one confirmation message and will not receive any further SMS messages unless they opt in again. Opt-out requests are honored immediately.

6. Getting help (HELP)

Recipients can reply HELP to any message for assistance, or contact us at support@fractalapps.dev.

7. Privacy and handling of mobile information

We do not sell, rent, or share mobile phone numbers or SMS opt-in/consent data with any third parties for promotional or marketing purposes. Phone numbers and message content are shared only with our SMS delivery provider (Telnyx) for the sole purpose of delivering messages, and SMS opt-in consent information is never shared with third parties for their own marketing purposes. 8. Recipient consent and Sender responsibility

Senders are responsible for obtaining and maintaining appropriate consent from their Recipients before sending messages, in accordance with the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and other applicable laws. By using the Service, each Sender represents that it has obtained the necessary consent for every phone number it submits.
