These Terms of Service ("Terms") govern your access to and use of "SourceClip" ("the Extension") and the related services, features, and content provided by the "FractalApps" team ("the Company") (collectively, the "Service"). By installing, accessing, or using the Service, you agree to be bound by these Terms.
The Service lets you copy images and text from web pages and insert them into your Google Slides™ presentations and Google Docs™ documents, with the option to attach the source as a link or caption.
You must be able to form a binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal purposes in accordance with these Terms and any applicable policies.
You are responsible for your use of the Service and for any Content you process using the Service. You agree that you will:
You retain your rights in your Content. The Service inserts the image or text you copy into the Google Slides™ presentation or Google Docs™ document you choose. The Company does not claim ownership of your Content, presentations, or documents. You are solely responsible for ensuring you have the right to use any material you copy with the Service.
The Service offers a limited amount of free use. After the free tier is exhausted, continued use of certain features requires a paid subscription. Subscription fees and billing intervals are disclosed at the point of purchase and are billed in advance on a recurring basis (for example, monthly) through our payment processor, Stripe.
Your subscription renews automatically at the end of each billing period unless you cancel. You may cancel at any time through the subscription management portal; cancellation stops future charges, and your paid access continues until the end of the current billing period. Unless otherwise stated or required by law, fees already paid are non-refundable.
The Service relies on third-party services, including Google APIs (Google Slides™ and Google Docs™) and Stripe for payment processing. Your use of those services is subject to their respective terms and policies. The Company is not responsible for the availability, accuracy, or practices of third-party services.
The Company may modify, suspend, or discontinue the Service (in whole or in part) at any time, including to maintain security, comply with law, or improve features. The Company may suspend or terminate access to the Service if you violate these Terms or if continued use poses a security, legal, or operational risk.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The Company does not warrant that the Service will be uninterrupted or error-free, or that every image or text item will copy or insert successfully, as this depends on the source website and on Google's APIs.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO
YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE
SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE
TO THE CLAIM (OR, IF THE SERVICE IS FREE, USD $100).
You agree to defend, indemnify, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your Content, (b) your misuse of the Service, or (c) your violation of these Terms or applicable law.
These Terms are governed by the laws of the jurisdiction where the Company is established, without regard to conflict of laws principles. Where permitted, you agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Changes are effective when posted. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
