These Terms of Service ("Terms") govern your access to and use of "Accessibility Compliance Checker for Docs, Slides & Sheets" ("the App") and the related services, features, and content provided by Fractal Apps LLC ("the Company") (collectively, the "Service"). By installing, accessing, or using the Service, you agree to be bound by these Terms.
You must be able to form a binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business, educational, governmental, or personal purposes in accordance with these Terms and any applicable policies.
You are responsible for your use of the Service and for any Content you process using the Service. You agree that you will:
You retain your rights in your Content. The Service reads the document, presentation, or spreadsheet you have open, reports findings, applies the fixes you approve, and can generate a PDF from it. The Company does not claim ownership of your Content or of the PDFs the Service generates from it.
The Service identifies accessibility problems that can be determined from the source document, and generates a tagged PDF that is validated against the PDF/UA standard before it is returned to you.
The Service does not certify compliance, and a clean result is not a determination that any document, website, or organization complies with the Americans with Disabilities Act, Section 508, the Web Content Accessibility Guidelines, ISO 14289 (PDF/UA), or any other law, regulation, or standard. Many accessibility requirements cannot be evaluated automatically and require human judgment - among them whether a description is accurate, whether a table holds data or is used for layout, and whether meaning is conveyed by something other than the document's structure. The App reports these for your decision rather than resolving them.
Nothing in the Service or on the Company's websites constitutes legal advice. You are responsible for determining what the law requires of you, and for obtaining your own legal advice.
Certain suggestions - image descriptions, link text, document titles, headings, slide titles, sheet names, and equations written out in words - are generated by a third-party language model, as described in the Privacy Policy. These suggestions may be inaccurate, incomplete, or unsuitable for your document. The App shows you each suggestion and, where the model reports low confidence, withholds it from automatic application. You are responsible for reviewing what is written into your documents.
The Service modifies your document when you approve a fix. Changes are made using Google's standard editing interfaces and can be reverted with the editor's own Undo command (Ctrl+Z / Cmd+Z), and through Google's version history.
Because of limitations in the interfaces made available to Google Workspace add-ons, certain formatting may not be preserved exactly when an element is rewritten. You are responsible for maintaining your own copies and version history of any document you use with the Service, and the Company is not responsible for any loss of formatting, content, or document state.
The Service can generate a tagged PDF from your document and save it to your Google Drive. This is a new rendering of the document rather than a copy of Google's own PDF export, and is produced to preserve the structure that Google's export does not carry.
Some visual features are not reproduced, including manual page breaks, columns, headers and footers, text boxes, and positioned drawings. Every export is checked against the PDF/UA standard and the result is reported to you; that result reflects the automatically verifiable conditions only, and is not a certification. PDF export is currently available for Google Docs™; the App will tell you when it is not available for a given file rather than producing one that would fail.
New accounts include a limited number of free checks. A check that finds no issues does not count against that allowance. Applying fixes, generating AI-written suggestions, and exporting a PDF are covered by the check that produced the findings and are not charged separately.
Continued use beyond the free allowance requires a paid subscription, billed monthly through Stripe at the price displayed at the time of purchase. Subscriptions renew automatically until cancelled. You may cancel at any time through the billing portal linked in the App; cancellation takes effect at the end of the current billing period. Access to paid features ends when a subscription lapses, including where a payment fails. Unless otherwise stated, payments are non-refundable except where required by law.
Subscriptions are individual and are associated with the Google account that purchased them. The Company may change pricing on notice; a change does not affect the current billing period.
The Company may modify, suspend, or discontinue the Service (in whole or in part) at any time, including to maintain security, comply with law, or improve features. The rules the App checks, and the way findings are presented, may change as standards and guidance change. The Company may suspend or terminate access to the Service if you violate these Terms or if continued use poses a security, legal, or operational risk.
The Service relies on third-party providers, including Google, Stripe, and the hosting and email providers named in the Privacy Policy. Interruption or change to those services may affect the Service. References to WCAG, PDF/UA, ISO 14289, the Matterhorn Protocol, Section 508, and the ADA are references to published standards and law maintained by their respective bodies; the Company is not affiliated with, endorsed by, or acting on behalf of any of them.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL IDENTIFY EVERY ACCESSIBILITY PROBLEM IN A DOCUMENT, THAT ITS SUGGESTIONS WILL BE ACCURATE OR SUITABLE, OR THAT ANY DOCUMENT OR EXPORTED FILE WILL SATISFY ANY LEGAL OR REGULATORY REQUIREMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR ANY
CLAIM, PENALTY, OR PROCEEDING ARISING FROM AN ALLEGED FAILURE TO COMPLY WITH ANY ACCESSIBILITY LAW OR
STANDARD, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR
RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS
PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR, IF THE SERVICE IS FREE, USD $100).
You agree to defend, indemnify, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your Content, (b) your misuse of the Service, (c) your violation of these Terms or applicable law, or (d) any claim that a document you produced or published, whether or not processed by the Service, fails to meet an accessibility requirement.
These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles. Where permitted, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Illinois for disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Changes are effective when posted. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
